Data notice (how we handle information about people named in public records)
In short
Gathersight shows information about care businesses in England and about the people who run them. All of it comes from public records that are published by law: CQC and Ofsted data, Companies House, the Charity Commission, the London Gazette and council planning portals. We show a person's name only where a public record names them in a public role: registered manager, nominated individual, director, person with significant control, charity trustee, or the applicant or agent on a planning application. We do not estimate, infer or buy personal information, and we never show anyone's home address, personal phone number or personal email address. If you are named and you want something corrected, or you want your name removed from Gathersight, email privacy@gathersight.com. We act within 30 days, and sooner where the public record itself has changed.
Who we are
Gathersight Ltd, a company registered in England and Wales, number 13563243, registered office 71-75 Shelton Street, London WC2H 9JQ. We are the controller of the information described in this notice. Our data protection officer can be reached at privacy@gathersight.com. We are registered with the Information Commissioner's Office, registration [to be supplied — not yet published here].
What we hold and where it comes from
| Source | What we take | How often |
|---|---|---|
| CQC data (adult social care) | Location and provider names, addresses of registered locations, registration dates and status, beds and service types, ratings, the names of registered managers and nominated individuals | Daily |
| Ofsted data (children's social care) | Provider and setting details as Ofsted publishes them; owning organisation; whether a manager is registered. Ofsted does not publish the names or addresses of children's homes and we do not attempt to identify them | Weekly and at each annual publication |
| Companies House | Company details, filings, officers (names, appointment dates, month and year of birth as published), persons with significant control, charges | Daily |
| Charity Commission | Charity details and trustees' names | Weekly |
| The London Gazette | Insolvency and corporate notices, including the names of office-holders and petitioners | Daily |
| Planning portals of local planning authorities (via [PlanWire]) | Application reference, site, description, status, dates, and the applicant and agent names as published | Daily |
We keep every version of these records so that we can show what changed and when. Every change we show carries the date the source showed it and the date we saw it, and names its source.
Why we hold it, and our lawful basis
We process this information on the basis of legitimate interests (UK GDPR Article 6(1)(f)): ours, in providing a service that tells businesses which care providers have changed; our customers', in knowing who is responsible for a regulated care business they may supply, lend to or buy; and the public interest that the regulators and registrars serve by publishing it. We have assessed the balance against the interests and rights of the people named. The information concerns professional roles, is already published by law, and we add nothing private to it. A copy of our assessment is available on request.
Who sees it
Subscribers to Gathersight: businesses that supply, lend to or buy care providers. They see names on paid plans, and on our free plan for the first fourteen days. Our terms require them to use the information for their own business purposes and not to resell it, build their own database from it, or contact anyone in a way that breaks the law. We do not sell personal information and we do not share it with anyone else except the service providers who run Gathersight (hosting, database, email, payments, and the model service that writes our one-line summaries), each under a contract that restricts what they may do with it.
Why we have not written to you directly
Data-protection law asks us to tell people when we hold information about them that we did not collect from them. These public data sources name tens of thousands of people, and writing to each one individually would take an effort out of proportion to the processing, which the law recognises (Article 14(5)(b)). This notice is how we make the information available instead: it is linked from every page of our website, from every record that names a person, and from every email we send.
How long we keep it
While a person holds a public role recorded in the sources, and for six years after the last public record naming them, after which we remove the name. We keep the record of the business and its changes.
Your rights
You may ask what we hold about you (access), ask us to correct it, object to our processing it, or ask us to remove your name. Write to privacy@gathersight.com with your name and the role or business you are named against. We reply within 30 days. Where a public record has changed, we update within two working days of being told. Where you object, we will stop showing your name unless we can show a compelling reason that overrides your interests, which for a professional role in a public record we would expect to be rare. If you are not satisfied, you may complain to the Information Commissioner's Office (ico.org.uk).
Children
We hold no information about children or about the people who live in care settings. Our sources describe providers, not residents.
